Question posted in the Consumer Protection Law category relating to Gauteng

I bought the vehicle and took delivery of the vehicle  on Saturday 7th June 2014.

·         Vehicle price was R529 950.00 of which a paid R100 000.00 deposit and financed the balance through Wesbank.  (Account Number : 85219005998)

·         On 24th October, I took the vehicle when the first service was due since I had the car and Mercedes refused to fix the right hand side  light as they suspected the vehicle was accident damaged and the entire car was resprayed.

·         The same day 24th October  I informed the dealer that I wanted a refund of my deposit and to return the car.

·         The dealer took my vehicle on Monday 3rdNovember to have the right hand fender /  bumper  fixed and the bonnet re-sprayed as well as the right side head light fixed. The Vehicle was returned to me on the 7thNovember 2014. The light was not fixed.

·         While they had my car they rented a vehicle for me to use while they repair my car.

·         The  week 09 – 11 November 2014,  I travelled to the Drakensberg , it was raining and water was seeping through the front windscreen.

·         Upon return I took the car to PG glass  The Glen where I had to pay out of my pocket to have the windscreen re-fitted as the entire windscreen was loose only held in place by silicone on one area on the left hand side  and the rubber seal. I notified the dealer telephonically of my dissatisfaction as well as the issue with the windscreen.

·         After  inspecting the car in more detail I noticed the following and notified the dealer as well on the 11th February 2015

o   The longer I have the vehicle I am convinced damage  repair   work has been done on the vehicle.

o   Right side Badge  on the fender is missing,

o   Right rear door is hard to open,

o   Right rear door panel has been refitted,

o    I fixed the right side Lights control unit

o   Shocks replaced  damaged on the right side,

o   Wind noise on the right side

·         On Friday 27th February the dealer made me an offer with which I am not satisfied and has not replied to either. Please see below.

Please advise on what legal recourse I have against the dealer.
